H-2 Foreign Labor

The firm represents growers, farm labor contractors, and other agricultural operations to properly employ foreign H-2A employees during the peak temporary or seasonal times of the year. Similarly, Deason also helps non-agricultural companies, such as construction, landscaping, manufacturers and hospitality companies to employ H-2B labor.

Over the past 15 years, the Firm has been involved in helping companies to sponsor hundreds of H-2 workers from Mexico, Peru, and Chile. Services include providing general H-2 visa eligibility information, assisting companies to understand regulatory parameters before entering the H-2 program, preparation of labor contracts to support H-2A/H-2B petition filings, advice regarding recordkeeping, submission of petitions to the various federal and state officials who must approve the petitions, appeals of labor certification denials, and visa processing at the U.S. Consulates. Our representative experience includes assisting employers to process H-2A and H-2B visas at all of the U.S. Consulates in Mexico.

Government inspections relating to H-2A, H-2B and various visa programs have dramatically increased in recent years due. Deason’s H-2 services also include providing employers with representation during an audit or lawsuit pursued by any one of numerous agencies who may seek to enforce violations, such as wage and hour compliance actions by the Department of Labor, H-2 desktop audits performed by the Employment and Training Administration and citizenship discrimination claims pursued by the DOJ agency Office of Immigrant and Employee Rights. Our litigation experience in the H-2 world will serve your company well when filing H-2A applications.
